As Oral Arguments Conclude in Landmark Climate Change Case, Progressives Tell Congress: It’s Time to Rebalance SCOTUS

WASHINGTON, D.C. — Today, the Supreme Court heard oral arguments in West Virginia v. Environmental Protection Agency (EPA), the most significant climate justice case to come before the Court in several years. In the wake of today’s arguments and questioning from the bench, progressive leaders and climate justice advocates are telling Congress now is the time to act to restore ideological balance to the nation’s highest court.

Stand Up America’s Managing Director of Policy & Political Affairs Brett Edkins released the following statement responding to today’s arguments:

“While climate experts and scientists at the EPA are working hard to safeguard Americans’ health and tackle the climate crisis, corporate polluters and right-wing politicians are leveraging the Supreme Court’s conservative supermajority to gut the Clean Air Act and hamstring the EPA. 

“Right-wing and corporate power players are using the Trump-stacked Court to make yet another power grab and eliminate the federal government’s ability to protect Americans’ health and the environment. Congress must seize this moment to pass the Judiciary Act, which would restore balance to the Supreme Court by adding 4 seats to the Court and protect our fundamental rights. The conservative supermajority is likely to side with right-wing, pro-Big Oil special interests in this case, and there is simply too much at stake for Congress to stand idly by.”
